Senator Weld moved to amend the bill on page 2, section 13, lines 20 through 23, by striking out all of subsection (f) and inserting in lieu thereof a new subsection (f), to read as follows:
(f) In addition to any other remedies that may be provided by law, any person aggrieved by a violation of this section by any department, agency, or political subdivision of this state, or any officer of the same acting in his or her official capacity may seek:
(1) A writ of prohibition pursuant to §53-1-1 et seq. of this code; or
(2) Injunctive relief pursuant to §53-5-1 et seq. of this code.
Any petition seeking relief under this subsection shall be filed in the circuit court of the county in which the alleged violation occurred. Upon a finding by the court that a violation of this section has occurred, the prevailing party shall be awarded actual damages as well as the costs of such action, including reasonable attorneys’ fees.
