A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 8 of Title 46.2 a section numbered 46.2-818.3, relating to traffic control device violation or traffic light signal violation monitoring systems; school bus video-monitoring systems; inspection of photograph, video, recording, etc., of certain violations.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 8 of Title 46.2 a section numbered 46.2-818.3 as follows:

§ 46.2-818.3. Photograph, video, recording, etc., of certain violations; availability for inspection; evidence.

A. For the purposes of this section, "traffic control device violation monitoring system" and "traffic light signal violation monitoring system" mean the same as those terms are defined in § 15.2-968.1.

B. Notwithstanding any other provision of law, including §§ 15.2-968.1 and 46.2-844, a certificate sworn to or affirmed by a law-enforcement officer, certified special conservator of the peace, or technician employed by a locality authorized to impose penalties for certain traffic violations who has obtained and inspected photographs, microphotographs, video, recorded images, or other recordings from a (i) traffic light signal violation monitoring system, (ii) traffic control device violation monitoring system, or (iii) video-monitoring system installed and operated on a school bus that produces live and digitally recorded video of motor vehicles passing a stopped school bus shall be considered prima facie evidence of the facts contained in such photographs, microphotographs, video, recorded images, or other recordings. Such photographs, microphotographs, video, recorded images, or other recordings shall be available for inspection by any party in a civil proceeding arising out of the violation pursuant to an ordinance adopted by a locality pursuant to § 15.2-968.1 or 46.2-844.
