A BILL TO BE ENTITLED
AN ACT to provide that a clerk of superior court who meets certain criteria is exempt from the prohibition against carrying a weapon in a courthouse.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 14‑269.4 is amended by adding a new subdivision to read:
"(7) Any person who is an elected or appointed clerk of court while the person is discharging his or her official duties, provided all of the following criteria are satisfied:
a. The weapon is a handgun.
b. The person (i) has a concealed handgun permit issued in accordance with Article 54B of this Chapter or considered valid under G.S. 14‑415.24, (ii) has been certified under applicable law as having completed a basic law enforcement training course as defined in Chapter 17C or Chapter 17E of the General Statutes, or (iii) has successfully completed a one‑time weapons retention training substantially similar to that provided to certified law enforcement officers in North Carolina.
c. The person secures the handgun in a locked compartment when the handgun is not on his or her person."
SECTION 2. This act becomes effective December 1, 2013.
