AN ACT to amend the penal law, in relation to certain persons engaging
in certain firearm safety shooting instruction or persons engaging in
wildlife control or management
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Paragraphs (i) and (j) of subdivision 3 of section 265.01-e
2 of the penal law, as added by chapter 371 of the laws of 2022, are
3 amended and two new paragraphs (k) and (l) are added to read as follows:
4 (i) persons lawfully engaged in hunting activity, including hunter
5 education training; [or]
6 (j) persons operating a program in a sensitive location out of their
7 residence, as defined by this section, which is licensed, certified,
8 authorized, or funded by the state or a municipality, so long as such
9 possession is in compliance with any rules or regulations applicable to
10 the operation of such program and use or storage of firearms[.];
11 (k) persons engaging in firearm safety shooting instruction conducted
12 at a camp regulated by article thirteen-B or fourteen of the public
13 health law or operating pursuant to a temporary residence permit as
14 required by paragraph (o) of subdivision five of section two hundred
15 twenty-five of the public health law and any regulations promulgated by
16 the commissioner of health, at an approved shooting range, provided that
17 such instruction is under the direction of a certified shooting instruc-
18 tor as approved by a local or county health department; or
19 (l) authorized persons engaged in wildlife control or management at a
20 sensitive location when a firearm is required to manage wildlife as
21 authorized by the department of environmental conservation, department
22 of health or other law enforcement agency.
23 § 2. This act shall take effect immediately.
