AN ACT

To amend chapter 571, RSMo, by adding thereto one new section relating to firearms restrictions in landlord-tenant agreements.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 571, RSMo, is amended by adding thereto one new section, to be known as section 571.510, to read as follows:

            571.510. 1. Notwithstanding any provision of law to the contrary, no lessor shall prohibit a lessee from possessing firearms within an individual residence or from carrying or transporting firearms to and from such residence in a manner allowed by law. Any provision of a lease or oral agreement between a lessor and lessee in violation of this section shall be void and unenforceable.

            2. Notwithstanding the provisions of section 571.107, no private property owner who is a lessor shall prohibit carrying a concealed weapon in common areas or in any location where carrying a concealed weapon is in accordance with the requirements of subsection 1 of this section. A lessor may prohibit carrying a concealed weapon under section 571.107 in the lessor’s office building or personal residence.

            3. The requirements of this section shall not apply to lessors who rent a portion of their own personal residence to lessees or to lessors renting personal residences where such properties were not acquired by the lessor for the primary purpose of rental income.

            4. No lessor shall be liable in tort or any other civil action for damages caused by a lessee’s possession or use of a firearm on property owned by the lessor, unless the lessor violated section 571.060 or otherwise caused the lessee to engage in any unsafe or illegal actions with a firearm.
