A bill to prohibit employees of certain federal agencies from
carrying firearms in this state; to provide for the powers and
duties of certain state agencies; and to prescribe penalties.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act shall be known and may be cited as the
"regulatory agency demilitarization act".
Sec. 3. (1) Not later than 30 days after the effective date of
this act, an employee of a federal agency shall not carry a firearm
in this state in the course of his or her employment with that
federal agency.
(2) An individual that violates this act is guilty of a felony
punishable by imprisonment for not more than 5 years or a fine of
not more than $2,500.00.
Sec. 5. If requested by a federal agency, the department of
state police may provide assistance to that federal agency in an
emergency.
Sec. 7. As used in this act:
(a) "Emergency" means that term as defined in section 15d of
chapter IV of the code of criminal procedure, 1927 PA 175, MCL
764.15d.
(b) "Federal agency" means that term as defined in 40 USC 102,
but does not include any of the following:
(i) The United States department of defense.
(ii) The United States department of justice.
(iii) The United States department of homeland security.
(iv) The nuclear regulatory commission.
(v) The United States capitol police.
(vi) The bureau of diplomatic security.
(vii) The central intelligence agency.
(viii) The military departments, as that term is defined in 5
USC 102.
(c) "Firearm" means that term as defined in section 222 of the
Michigan penal code, 1931 PA 328, MCL 750.222.
