A
Joint
Resolution
expressing
the
Iowa
General
Assembly’s

refusal
to
recognize
or
support
any
statutes,
presidential

directives,
or
other
regulations
and
proclamations
which

conflict
with
the
Second
Amendment
of
the
Constitution
of
4
the
United
States
and
which
are
expressly
preempted
by
the
5
rulings
of
the
United
States
Supreme
Court.

WHEREAS,
the
Second
Amendment
to
the
Constitution
of
the
7
United
States
provides
that
“A
well
regulated
militia,
being
8
necessary
to
the
security
of
a
free
state,
the
right
of
the
9
people
to
keep
and
bear
arms,
shall
not
be
infringed”;
and
10
WHEREAS,
the
Second
Amendment
protects
the
rights
of
11
self-defense,
defense
of
others,
and
defense
of
the
nation;
and
12
WHEREAS,
it
is
estimated
that
more
than
70
million
people,
13
representing
more
than
half
of
the
households
in
America,
have
14
chosen
to
lawfully
exercise
the
right
to
bear
arms
and
defend
15
themselves
and
their
families;
and
16
WHEREAS,
the
vast
majority
of
all
lawfully
owned
firearms
in
17
America
are
not
used
in
crime;
and
18
WHEREAS,
the
United
States
Supreme
Court
in
District
of
19
Columbia
v.
Heller,
554
U.S.
570
(2008),
ruled
that
the
Second
20
Amendment
protects
an
individual’s
right
to
keep
and
bear
21
arms;
and
22
WHEREAS,
the
United
States
Supreme
Court
in
McDonald
v.
23
City
of
Chicago,
561
U.S.
3025
(2010),
ruled
that
the
right
of
24
an
individual
to
keep
and
bear
arms
protected
by
the
Second
25
Amendment
is
incorporated
by
the
Due
Process
Clause
of
the
26
Fourteenth
Amendment
to
the
Constitution
of
the
United
States

and
applies
to
the
states;
and
28
WHEREAS,
studies
by
the
National
Academies
of
Science

persuasive

that
“gun
control”
laws
actually
reduce
crime;
NOW

THEREFORE,

IT
RESOLVED
BY
THE
GENERAL
ASSEMBLY
OF
THE
STATE
OF
IOWA:

That
the
General
Assembly
of
the
State
of
Iowa
will
uphold
1
the
Second
Amendment
to
the
Constitution
of
the
United
States
2
and
will
act
in
conformity
with
its
members’
sworn
duties
as
3
duly
elected
officials
charged
with
the
public
trust;
and
4
BE
IT
FURTHER
RESOLVED,
That
the
General
Assembly
of
5
the
State
of
Iowa
will
not
act
to
enforce
any
statutes,
6
presidential
directives,
or
other
regulations
and
proclamations
7
which
conflict
with
the
Second
Amendment
to
the
Constitution
8
of
the
United
States
and
that
are
expressly
preempted
by
the
9
rulings
of
the
United
States
Supreme
Court;
and
10
BE
IT
FURTHER
RESOLVED,
That
the
Secretary
of
the
Senate
11
shall
transmit
certified
copies
of
this
Joint
Resolution
to
12
the
President
of
the
United
States,
the
Speaker
of
the
United
13
States
House
of
Representatives,
the
President
of
the
United
14
States
Senate,
the
Majority
and
Minority
Leaders
of
the
United
15
States
Senate
and
the
United
States
House
of
Representatives,
16
and
to
each
member
of
Iowa’s
congressional
delegation.

EXPLANATION

This
joint
resolution
expresses
the
Iowa
General
Assembly’s
19
refusal
to
recognize
or
support
any
statutes,
presidential
20
directives,
or
other
regulations
and
proclamations
which
21
conflict
with
the
Second
Amendment
to
the
Constitution
of
the
22
United
States
and
which
are
expressly
preempted
by
the
rulings
23
of
the
United
States
Supreme
Court.
