Section
1.
Section
481A.54,
Code
2021,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
2A.
A
person
shall
not
discharge
a
3
weapon
from
a
snowmobile,
all-terrain
vehicle,
or
any
other
4
motor
vehicle,
as
defined
in
section
321.1,
except
that
a
5
nonambulatory
person
may
discharge
a
firearm
from
a
snowmobile
6
or
all-terrain
vehicle
as
provided
in
section
321G.13,
7
subsection
2,
paragraph
“c”
,
or
section
321I.14,
subsection
8
2,
paragraph
“c”
.
This
subsection
does
not
prohibit
a
person
9
who
uses
a
stationary
motor-driven
land
conveyance
intended
to
10
accommodate
that
person’s
physical
disability
from
hunting
from
11
the
conveyance,
as
provided
by
rules
adopted
by
the
department
12
pursuant
to
section
483A.8C.
For
purposes
of
this
subsection,
13
“weapon”
means
a
firearm,
bow
and
arrow,
crossbow,
or
any
other
14
hunting
weapon.

EXPLANATION
16
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
17
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
discharging
a
weapon
from
a
motor
19
vehicle.
20
Current
law
generally
prohibits
discharging
a
firearm
from
21
a
snowmobile
or
all-terrain
vehicle.
The
bill
prohibits
a
22
person
from
discharging
a
weapon
from
a
snowmobile,
all-terrain
23
vehicle,
or
any
other
motor
vehicle
except
that
a
nonambulatory
24
person
may
discharge
a
firearm
from
a
snowmobile
or
all-terrain
25
vehicle
while
lawfully
hunting
if
the
person
is
not
operating
26
or
riding
a
moving
snowmobile
or
all-terrain
vehicle.
The
bill
27
does
not
prohibit
a
person
who
uses
a
stationary
motor-driven
28
land
conveyance
intended
to
accommodate
that
person’s
29
disability
from
hunting
from
the
conveyance.
