Section 724.22, subsection 5, Code 2017, is 1 2 amended to read as follows: 1 3 5. A parent,orguardian, or spouse who is twenty=one years 1 4 of age or older, of a personfourteen years of age but less than 1 5below the age of twenty=one may allow the person to possess a 1 6 pistol or revolver or the ammunition therefor for any lawful 1 7 purpose while under the direct supervision of the parent,or1 8 guardian, or spouse who is twenty=one years of age or older, or 1 9 while the person receives instruction in the proper use thereof 1 10 from an instructor twenty=one years of age or older, with the 1 11 consent of such parent, guardian, or spouse. 1 12 EXPLANATION 1 13 The inclusion of this explanation does not constitute agreement with 1 14 the explanation's substance by the members of the general assembly. 1 15 Under this bill, a parent or guardian or spouse who is 21 1 16 years of age or older, or another with the consent of the 1 17 minor's parent or guardian or spouse who is 21 years of age 1 18 or older, may allow a person below 21 years of age to possess 1 19 a pistol or revolver or the ammunition therefor, while under 1 20 supervision, which then may be lawfully used. 1 21 Current law allows a parent, guardian, or spouse who is 21 1 22 years of age or older, of a person at least 14 years of age 1 23 but below 21 years of age, to possess a pistol or revolver or 1 24 the ammunition therefor, while under supervision, which may 1 25 lawfully be used. However, current law prohibits a parent 1 26 or guardian or spouse who is 21 years of age or older from 1 27 allowing a person under 14 years of age from possessing a 1 28 pistol or revolver or the ammunition. 1 29 Except for the circumstances under Code section 724.22(4) 1 30 (security personnel) or this bill, a person who sells, loans, 1 31 gives, or makes available a pistol or revolver or ammunition 1 32 for a pistol or revolver to a person below the age of 21 commits 1 33 a serious misdemeanor for a first offense and a class "D" 1 34 felony for second and subsequent offenses. 1 35 The bill does not address a rifle or shotgun but current law 2 1 does allow a parent, guardian, or spouse who is 18 years of age 2 2 or older, or another with the express consent of the minor's 2 3 parent or guardian or spouse who is 18 years of age or older may 2 4 allow a minor to possess a rifle or shotgun or the ammunition 2 5 therefor which may be lawfully used. A serious misdemeanor is 2 6 punishable by confinement for no more than one year and a fine 2 7 of at least $315 but not more than $1,875. A class "D" felony 2 8 is punishable by confinement for no more than five years and a 2 9 fine of at least $750 but not more than $7,500. LSB 1852XS (3) 87 jm/rh/rj
