1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Attorney General Act is amended by changing
5Section 6.3 as follows:
 
6    (15 ILCS 205/6.3)
7    Sec. 6.3. Worker Protection Unit.
8    (a) The General Assembly finds that the welfare and
9prosperity of all Illinois citizens and businesses requires
10the establishment of a Unit within the Attorney General's
11Office dedicated to combatting businesses that underpay their
12employees, force their employees to work in unsafe conditions,
13and gain an unfair economic advantage by avoiding their tax
14and labor responsibilities. The Worker Protection Unit shall
15be focused on protecting the State's workforce to ensure
16workers are paid properly, guarantee safe workplaces, and
17allow law-abiding business owners to thrive through healthy
18and fair competition. Businesses that violate the State's
19worker protection laws put a greater burden on taxpayers by
20hurting the State's ability to provide critical services;
21compliant businesses cannot compete against those who gain an
22unfair advantage by evading their responsibilities.
23    (b) There is created within the Office of the Attorney

1General a Worker Protection Unit, consisting of Assistant
2Attorneys General appointed by the Attorney General, who,
3together with other staff as deemed necessary by the Attorney
4General, shall have the power and duty on behalf of persons
5within this State, to intervene in, initiate, and enforce all
6legal proceedings on matters related to the payment of wages,
7the safety of the workplace, and fair employment practices,
8including, without limitation, the provisions of the
9Prevailing Wage Act, the Employee Classification Act, the
10Minimum Wage Law, the Day and Temporary Labor Services Act, or    
11the Wage Payment and Collection Act, and any other law
12regarding labor or employment in this State, whenever the
13Attorney General determines that such action is necessary to
14protect the rights and interests of Illinois workers and
15Illinois businesses.
16    (c) Prior to initiating an action, the Attorney General
17shall conduct an investigation and may: (1) require an
18individual or entity to file a statement or report in writing
19under oath or otherwise, as to all information the Attorney
20General may consider necessary; (2) examine under oath any
21person alleged to have participated in or with knowledge of
22the alleged violation; or (3) issue subpoenas for documents;
23(4) require written answers under oath to written
24interrogatories; (5) or conduct hearings in aid of any
25investigation; (6) inspect the premises of an employer and
26inspect and make copies of employment-related records kept at

1the premises during normal business or working hours or at
2other reasonable times; and (7) conduct interviews with
3employees at an employer's premises during normal business or
4working hours or at other reasonable times.
5    (c-5) An employer, or an agent of the employer, who is
6subject to an investigation by the Attorney General shall make
7all reasonable efforts to cooperate with the investigation,
8including, without limitation, by making the employer's
9premises and records available for inspection and by
10permitting the employer's employees to participate in
11confidential interviews conducted by the Attorney General. An
12employer who is subject to an investigation by the Attorney
13General under this Section has the right to be assisted by
14counsel.
15    (c-10) Any individual, including an employee, who
16voluntarily participates in an interview conducted by the
17Attorney General or otherwise provides information to the
18Attorney General related to an investigation conducted by the
19Worker Protection Unit is a confidential government informer
20for purposes of asserting the government informer's privilege.
21    (c-15) The production of documentary material in response
22to a subpoena served in accordance with this Section shall be
23made under a sworn certificate, in such form as the subpoena
24designates, by the person, if a natural person, to whom the
25demand is directed or, if not a natural person, by a person or
26persons having knowledge of the facts and circumstances

1relating to the production, to the effect that all of the
2documentary material required by the demand and in the
3possession, custody, or control of the person to whom the
4demand is directed has been produced and made available to the
5custodian. All answers to interrogatories and statements or
6reports produced in writing shall be accompanied by a
7statement under oath attesting to the accuracy of the answers.
8    (c-20) Any person who has been served a subpoena issued
9under this Section may file, in the Circuit Court of Sangamon
10or Cook County or the circuit court of the county in which the
11witness resides, is found, or transacts business, a petition
12for an order to modify or set aside the subpoena. A petition
13filed with the circuit court under this subsection shall be
14filed with the court and served on the Attorney General within
1520 days after the date of service of the subpoena or at any
16time before the return date specified in the subpoena,
17whichever date is earlier, or within a longer period as may be
18prescribed in writing by the Attorney General. The petition
19shall specify the grounds upon which the petitioner relies in
20seeking relief.
21    (c-25) If a witness served with a subpoena by the Attorney
22General under this Act fails or refuses to attend a proceeding
23and provide testimony, produce documentary materials or
24interrogatory answers, grant access to the premises, records,
25or employees of the witness, or otherwise comply with the
26subpoena, the Attorney General may petition the Circuit Court

1of Sangamon or Cook County, or the circuit court in the county
2in which the witness resides, for an order requiring the
3witness to comply with the subpoena. The court's order shall
4require the witness comply with the subpoena by a specified
5date and provide a date on which the witness shall show cause
6in court as to why the witness should not be held in contempt
7of court if the witness fails to comply with the order. If the
8witness is held in contempt of court, the Attorney General may
9seek a writ of attachment, monetary fine, or an equivalent
10court order.
11    (c-30) An individual, including an employer, an agent of
12the employer, or the officer or agent of any private employer,
13who, with the intent to avoid, evade, prevent, or obstruct
14compliance in whole or in part by any person who has been
15served a subpoena by the Attorney General under this Section,
16knowingly removes from any place, conceals, withholds,
17destroys, mutilates, alters, or by any other means falsifies
18any documentary material that is the subject of the subpoena
19is guilty of a Class A misdemeanor.
20    (c-35) If, in the course of an investigation conducted in
21accordance with subsection (c), the Attorney General believes
22that relevant evidence of a violation of a law enforced by the
23Worker Protection Unit as set forth in subsection (b) is
24located at the premises of an employer or in an employer's
25records and if the employer has refused to allow the Attorney
26General to inspect the premises or the Attorney General has

1reasonable cause to believe that an immediate inspection of
2the premises is necessary to carry out its investigation, then
3the Attorney General may file or cause to be filed an
4application for an administrative inspection warrant. The
5issuance and execution of an administrative inspection warrant
6shall be as follows:
7        (1) A judge of a circuit court, upon proper oath or
8    affirmation showing probable cause, may issue warrants for
9    the purpose of conducting administrative inspections and
10    seizures of property appropriate to the inspections. For
11    the purposes of the issuance of an administrative
12    inspection warrant, probable cause exists upon the showing
13    of a valid public interest in the effective enforcement of
14    any statute enforced by the Worker Protection Unit,
15    sufficient to justify administrative inspection of the
16    employer's premises or records.
17        (2) An administrative inspection warrant shall be
18    issued only after receipt of an affidavit of a person
19    having knowledge of the facts alleged that establishes the
20    grounds for issuing the administrative inspection warrant.
21    If the circuit judge is satisfied that there is probable
22    cause to believe that grounds for issuance of an
23    administrative inspection warrant exist, the judge shall
24    issue an administrative inspection warrant. The
25    administrative inspection warrant shall:
26            (A) state the grounds for its issuance and the

1        name of each person whose affidavit has been taken in
2        support of the warrant;
3            (B) be directed to an Assistant Attorney General
4        appointed by the Attorney General or to other staff of
5        the Office of the Attorney General who will execute
6        the warrant;
7            (C) command the person to whom it is directed to
8        inspect the identified premises or records for the
9        purposes specified in the warrant and, if appropriate,
10        direct the seizure of the identified records or other
11        property;
12            (D) identify the item or types of property to be
13        seized, if any; and
14            (E) direct that the warrant may be served at any
15        time of the day or night and designate the circuit
16        court judge to whom it shall be returned.
17        (3) An administrative inspection warrant issued under
18    this subsection must be executed and returned within 10
19    days after the date of its issuance, unless, upon a
20    showing of a need for additional time, the court that
21    issued the inspection warrant orders otherwise. If
22    property is seized in accordance with an administrative
23    inspection warrant, a copy of the inventory of the seized
24    property shall be given to the person from whom or from
25    whose controlled premises the property is taken. If no
26    person is available, the inspection warrant and a copy of

1    the inventory shall be left at the controlled premises.
2    The inventory shall be made under oath by the person
3    executing the warrant.
4        (4) An administrative inspection warrant shall be
5    returnable before the judge of the circuit court who
6    issued the inspection warrant or any judge named in the
7    inspection warrant or before the circuit court. The judge
8    before whom the return is made shall attach to the
9    administrative inspection warrant a copy of the return and
10    all papers returnable in connection with the warrant and
11    file them with the clerk of the circuit court in which the
12    inspection warrant is executed.
13        (5) No warrant shall be quashed or evidence suppressed
14    because of technical irregularities not affecting the
15    substantial rights of the person responsible for the
16    employer's premises or property.
17        (6) This subsection does not prevent the inspection
18    without a warrant of books and records produced in
19    accordance with a subpoena issued under subsection (c).
20        (7) No administrative inspection warrant shall be
21    issued under this subsection with the intent of obtaining
22    evidence for an ongoing criminal investigation.    
23    (d) In an action brought under this Section, the Attorney
24General may obtain, as a remedy, monetary damages to the
25State, restitution, and equitable relief, including any
26permanent or preliminary injunction, temporary restraining

1order, or other order, including an order enjoining the
2defendant from engaging in a violation, or order any action as
3may be appropriate. In addition, the Attorney General may
4request and the court may impose a civil penalty against any
5person or entity found by the court to have violated any law
6regarding labor or employment in this State, including the
7Prevailing Wage Act, the Employee Classification Act, the
8Minimum Wage Law, the Day and Temporary Labor Services Act,
9the Wage Payment and Collection Act, or any other law related
10to the payment of wages, the safety of the workplace, or fair
11employment practices, in a sum not to exceed the maximum
12amount of any civil penalty prescribed by law. Neither the
13State nor an aggrieved individual may recover monetary relief,
14including civil penalties, in more than one proceeding related
15to the same violation.
16    (e) Upon the Attorney General's request, the Illinois
17Department of Labor shall provide any materials or documents
18already in the Department's possession pertaining to the
19enforcement of this Section. The Office of the Attorney
20General may use information obtained under this Section,
21including information that is designated as and that qualifies
22for confidential treatment, which information the Attorney
23General's Office shall maintain as confidential, for law
24enforcement purposes only, which information may be shared
25with other law enforcement officials. Nothing in this Section
26is intended to take away or limit any powers of the Attorney

1General under common law or other statutory law.
2    (f) All information and documentary materials that are
3obtained by the Attorney General under this Section are exempt
4from disclosure under the Freedom of Information Act. This
5exemption applies to all information and documentary materials
6the Attorney General obtains through an investigation under
7this Act.
8    Except as otherwise provided in this Section, no
9documentary materials, transcripts of oral testimony, or
10answers to interrogatories, or copies of those items, in the
11possession of the Attorney General shall be available for
12examination by any individual other than an authorized
13employee or agent of the Attorney General or a federal, State,
14or local law enforcement official without the consent of the
15person who produced the documentary materials, oral testimony,
16or answers. The Attorney General may provide copies of the
17documentary materials, transcripts of oral testimony, or
18answers to interrogatories to an official of this State, the
19federal government, or another state, who is charged with the
20enforcement of federal or State employment, antitrust, or
21consumer protection laws, if the receiving official agrees in
22writing, before the disclosure, that the information may not
23be disclosed to anyone other than the official or the
24official's authorized employees.
25    The Attorney General may, in the Attorney General's
26discretion, use information and documentary materials obtained

1in the course of an investigation pursuant to this Act for law
2enforcement purposes, including, but not limited to,
3interviewing or questioning potential witnesses and
4consultants, in a complaint or other pleading, and in court
5proceedings.

7    Section 10. The Freedom of Information Act is amended by
8changing Section 7.5 as follows:

12    Sec. 7.5. Statutory exemptions. To the extent provided for
13by the statutes referenced below, the following shall be
14exempt from inspection and copying:
15        (a) All information determined to be confidential
16    under Section 4002 of the Technology Advancement and
17    Development Act.
18        (b) Library circulation and order records identifying
19    library users with specific materials under the Library
20    Records Confidentiality Act.
21        (c) Applications, related documents, and medical
22    records received by the Experimental Organ Transplantation
23    Procedures Board and any and all documents or other
24    records prepared by the Experimental Organ Transplantation

1    Procedures Board or its staff relating to applications it
2    has received.
3        (d) Information and records held by the Department of
4    Public Health and its authorized representatives relating
5    to known or suspected cases of sexually transmitted
6    infection or any information the disclosure of which is
7    restricted under the Illinois Sexually Transmitted
8    Infection Control Act.
9        (e) Information the disclosure of which is exempted
10    under Section 30 of the Radon Industry Licensing Act.
11        (f) Firm performance evaluations under Section 55 of
12    the Architectural, Engineering, and Land Surveying
13    Qualifications Based Selection Act.
14        (g) Information the disclosure of which is restricted
15    and exempted under Section 50 of the Illinois Prepaid
16    Tuition Act.
17        (h) Information the disclosure of which is exempted
18    under the State Officials and Employees Ethics Act, and
19    records of any lawfully created State or local inspector
20    general's office that would be exempt if created or
21    obtained by an Executive Inspector General's office under
22    that Act.
23        (i) Information contained in a local emergency energy
24    plan submitted to a municipality in accordance with a
25    local emergency energy plan ordinance that is adopted
26    under Section 11-21.5-5 of the Illinois Municipal Code.

1        (j) Information and data concerning the distribution
2    of surcharge moneys collected and remitted by carriers
3    under the Emergency Telephone System Act.
4        (k) Law enforcement officer identification information
5    or driver identification information compiled by a law
6    enforcement agency or the Department of Transportation
7    under Section 11-212 of the Illinois Vehicle Code.
8        (l) Records and information provided to a residential
9    health care facility resident sexual assault and death
10    review team or the Executive Council under the Abuse
11    Prevention Review Team Act.
12        (m) Information provided to the predatory lending
13    database created pursuant to Article 3 of the Residential
14    Real Property Disclosure Act, except to the extent
15    authorized under that Article.
16        (n) Defense budgets and petitions for certification of
17    compensation and expenses for court appointed trial
18    counsel as provided under Sections 10 and 15 of the
19    Capital Crimes Litigation Act (repealed). This subsection
20    (n) shall apply until the conclusion of the trial of the
21    case, even if the prosecution chooses not to pursue the
22    death penalty prior to trial or sentencing.
23        (o) Information that is prohibited from being
24    disclosed under Section 4 of the Illinois Health and
25    Hazardous Substances Registry Act.
26        (p) Security portions of system safety program plans,

1    investigation reports, surveys, schedules, lists, data, or
2    information compiled, collected, or prepared by or for the
3    Department of Transportation under Sections 2705-300 and

6    Transportation Authority under Section 2.11 of the
7    Regional Transportation Authority Act, or the St. Clair
8    County Transit District under the Bi-State Transit Safety
9    Act (repealed).
10        (q) Information prohibited from being disclosed by the
11    Personnel Record Review Act.
12        (r) Information prohibited from being disclosed by the
13    Illinois School Student Records Act.
14        (s) Information the disclosure of which is restricted
15    under Section 5-108 of the Public Utilities Act.

24    Concealed Carry Act, unless otherwise authorized by the
25    Firearm Concealed Carry Act; and databases under the

6    Section 10 of the Firearm Owners Identification Card Act.
7        (w) Personally identifiable information which is
8    exempted from disclosure under subsection (g) of Section

22    review team or the Illinois Fatality Review Team Advisory
23    Council under Section 15 of the Adult Protective Services
24    Act.
25        (aa) Information which is exempted from disclosure
26    under Section 2.37 of the Wildlife Code.

2    disclosure by the Juvenile Court Act of 1987.

6        (dd) Information that is prohibited from being
7    disclosed under Section 45 of the Condominium and Common
8    Interest Community Ombudsperson Act.
9        (ee) Information that is exempted from disclosure
10    under Section 30.1 of the Pharmacy Practice Act.
11        (ff) Information that is exempted from disclosure
12    under the Revised Uniform Unclaimed Property Act.
13        (gg) Information that is prohibited from being
14    disclosed under Section 7-603.5 of the Illinois Vehicle
15    Code.

25        (tt) Recordings made under the Children's Advocacy
