1 | AN ACT concerning criminal law.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Unified Code of Corrections is amended by | |||||||||||||||||||||
5 | changing Sections 3-2-3 and 3-2-6 as follows:

7 | Sec. 3-2-3. Director; Appointment; Powers and Duties.

8 | (a) The Department shall be administered by the Director of | |||||||||||||||||||||
9 | Corrections
who shall be appointed by the Governor in | |||||||||||||||||||||
10 | accordance with The Civil
Administrative Code of Illinois.
| |||||||||||||||||||||
11 | (b) The Director shall establish such Divisions within the | |||||||||||||||||||||
12 | Department in
addition to those established under Section 3-2-5 | |||||||||||||||||||||
13 | as shall be desirable and
shall assign to the various Divisions | |||||||||||||||||||||
14 | the responsibilities and duties
placed in the Department by the | |||||||||||||||||||||
15 | laws of this State. | |||||||||||||||||||||
16 | (c) When ordering an early release of more than 50 | |||||||||||||||||||||
17 | prisoners during a one-month period, the Director must consult | |||||||||||||||||||||
18 | with the Advisory Board created under Section 3-2-6 of this | |||||||||||||||||||||
19 | Code and receive approval from the majority of the 11 members.

22 | Sec. 3-2-6. Advisory Boards. |

1 | (a) There shall be an Advisory Board within the Department | ||||||
2 | of Corrections composed of 11 persons, one of whom shall be a | ||||||
3 | senior citizen age 60
or over, appointed by the Governor to | ||||||
4 | advise the Director
on matters pertaining to adult offenders. | ||||||
5 | The
members of the Boards shall be qualified for their | ||||||
6 | positions by
demonstrated interest in and knowledge of adult | ||||||
7 | and juvenile correctional
work and shall not be officials of | ||||||
8 | the State in any other capacity. The 11 members must include | ||||||
9 | one member representing the Illinois Association of Chiefs of | ||||||
10 | Police, one member representing the Illinois State's Attorneys | ||||||
11 | Association, and one member representing the Administrative | ||||||
12 | Office of the Illinois Courts. The
members first appointed | ||||||
13 | under this amendatory Act of 1984
shall serve for a term of 6 | ||||||
14 | years and shall be appointed as soon as
possible after the | ||||||
15 | effective date of this amendatory Act of 1984. The
members of | ||||||
16 | the Boards now serving shall complete their terms as appointed,
| ||||||
17 | and thereafter members shall be appointed by the Governor to | ||||||
18 | terms of 6
years. Any vacancy occurring shall be filled in the | ||||||
19 | same manner for the
remainder of the term. The Director of | ||||||
20 | Corrections and the Assistant
Directors
shall be ex-officio | ||||||
21 | members of the Boards. Each Board shall elect a
chairman from | ||||||
22 | among its appointed members. The Director shall serve as
| ||||||
23 | secretary of each Board. Members of each Board shall serve | ||||||
24 | without
compensation but shall be reimbursed for expenses | ||||||
25 | necessarily incurred in
the performance of their duties. The | ||||||
26 | Board shall meet quarterly and at
other times at the call of |

1 | the chairman.

2 | (b) The Boards shall advise the Director concerning policy | ||||||
3 | matters and
programs of the Department with regard to the | ||||||
4 | custody, care, study,
discipline, training and treatment of | ||||||
5 | persons in the State correctional
institutions and for the care | ||||||
6 | and supervision of persons released on parole.
| ||||||
7 | (c) There shall be a Subcommittee on Women Offenders to the
| ||||||
8 | Advisory Board. The Subcommittee shall be composed of 3 members | ||||||
9 | of the
Advisory Board appointed by the Chairman who shall | ||||||
10 | designate one
member as the chairman of the Subcommittee. | ||||||
11 | Members of the Subcommittee
shall serve without compensation | ||||||
12 | but shall be reimbursed for expenses
necessarily incurred in | ||||||
13 | the performance of their duties. The Subcommittee
shall meet no | ||||||
14 | less often than quarterly and at other times at the call of its | ||||||
15 | chairman.

16 | The Subcommittee shall advise the Advisory Board and the
| ||||||
17 | Director on all policy matters and programs of the Department | ||||||
18 | with regard
to the custody, care, study, discipline, training | ||||||
19 | and treatment of women in
the State correctional institutions | ||||||
20 | and for the care and supervision of
women released on parole.
