1 | AN ACT concerning firearms.
| |||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||||||
4 | Section 1. Short title. This Act may be cited as the | |||||||||||||||||||||||
5 | Microstamping Funding Program Act.
| |||||||||||||||||||||||
6 | Section 5. Legislative findings. The General Assembly | |||||||||||||||||||||||
7 | finds that: | |||||||||||||||||||||||
8 | Law enforcement makes an arrest in only 35% of firearm | |||||||||||||||||||||||
9 | homicides and 21% of firearm
assaults when the victim was | |||||||||||||||||||||||
10 | Black or Hispanic.
Microstamping is a powerful crime-solving | |||||||||||||||||||||||
11 | tool that can help law enforcement quickly
solve gun crimes.
| |||||||||||||||||||||||
12 | Microstamping is a reliable ballistics identification tool, | |||||||||||||||||||||||
13 | and can greatly enhance
traditional ballistics analysis and | |||||||||||||||||||||||
14 | the current National Integrated Ballistics Information
Network | |||||||||||||||||||||||
15 | (NIBIN) system by providing a direct link between a spent | |||||||||||||||||||||||
16 | cartridge case and a
firearm. | |||||||||||||||||||||||
17 | The leads generated from fired cartridge cases, bearing | |||||||||||||||||||||||
18 | microstamps found at crime scenes, have the potential to help | |||||||||||||||||||||||
19 | law
enforcement solve gun-related crimes while limiting | |||||||||||||||||||||||
20 | negative interactions with law
enforcement, especially in | |||||||||||||||||||||||
21 | minority communities.
While this crime-solving technology | |||||||||||||||||||||||
22 | exists, firearm manufacturers have not yet produced
| |||||||||||||||||||||||
23 | microstamp-ready firearms.

| |||||||
1 | It behooves the State to install a program in partnership | ||||||
2 | with law enforcement to bring
microstamp-ready firearms into | ||||||
3 | use in Illinois.
| ||||||
4 | Section 10. Definitions. In this Act: | ||||||
5 | "CGIC" means the Crime Gun Intelligence Center. | ||||||
6 | "Microstamp-ready" means that the firearm is capable of | ||||||
7 | producing a unique
alphanumeric or geometric code on at least | ||||||
8 | one location on each expended cartridge
case that can be used | ||||||
9 | to identify the make, model, and serial number of the firearm. | ||||||
10 | "Microstamping component or mechanism" means a component | ||||||
11 | or mechanism of a firearm or an insertable component or | ||||||
12 | mechanism designed and intended
to produce a unique | ||||||
13 | alphanumeric or geometric code on an expended cartridge that
| ||||||
14 | identifies the make, model, and serial number of the firearm. | ||||||
15 | "NIBIN" means the National Integrated Ballistics | ||||||
16 | Information Network.
| ||||||
17 | Section 15. Grants for microstamp-ready firearms or | ||||||
18 | insertable microstamping components or mechanisms, or both. | ||||||
19 | (a) There is created in the State treasury the | ||||||
20 | Microstamp-ready Firearms Fund to be administered by the | ||||||
21 | Illinois Criminal Justice Information Authority for the | ||||||
22 | purpose of issuing grants to law enforcement agencies to | ||||||
23 | purchase or replenish microstamp-ready firearms or insertable | ||||||
24 | microstamping components or mechanisms to be installed in |

1 | firearms, or both, for their officers. | ||||||
2 | (b) Subject to appropriation, the State Comptroller shall | ||||||
3 | transfer from the General Revenue Fund to the Microstamp-ready | ||||||
4 | Firearms Fund $500,000 to establish a grant program for | ||||||
5 | microstamp-ready firearms in Illinois. The program shall | ||||||
6 | award: | ||||||
7 | (1) Replenishment grants: grants between $35,000 and | ||||||
8 | $50,000, for the
replenishment of new microstamp-ready | ||||||
9 | firearms or insertable microstamping components or | ||||||
10 | mechanisms, or both, for their law enforcement officers. | ||||||
11 | One of these grants shall be for
a State law enforcement | ||||||
12 | agency, and the other 3 shall be for 3 municipal law
| ||||||
13 | enforcement agencies of municipalities with a population | ||||||
14 | between 50,000 and
200,000 that purchase firearms for | ||||||
15 | their officers through a quartermaster
system, in which | ||||||
16 | the quartermaster is responsible for the purchase, | ||||||
17 | inventory,
and dissemination of uniforms and equipment to | ||||||
18 | officers. | ||||||
19 | (2) New officer grants: grants between $5,000 to | ||||||
20 | $20,000 to law enforcement
agencies of municipalities with | ||||||
21 | a population between 30,000 and 200,000 to
assist with the | ||||||
22 | purchase of firearms by new officers. | ||||||
23 | (c) Nothing in this Act prohibits State or municipal law | ||||||
24 | enforcement agencies from purchasing or replenishing | ||||||
25 | microstamp-ready firearms or insertable microstamping | ||||||
26 | components or mechanisms, or both, for their law enforcement |

1 | officers from funding sources independent of the provisions of | ||||||
2 | this Act.
| ||||||
3 | Section 20. Administration and restrictions. The grant | ||||||
4 | program shall be administered by the Illinois Criminal Justice | ||||||
5 | Information Authority and the grant funds shall only be used | ||||||
6 | for the purchase of microstamp-ready firearms or microstamping | ||||||
7 | components or mechanisms, or both, to be installed in firearms | ||||||
8 | by law enforcement agencies that are grant recipients.

9 | Section 25. Education and training. Education and training | ||||||
10 | associated with microstamp-ready firearms, and integration | ||||||
11 | with
the NIBIN and CGIC in Illinois shall be included in the | ||||||
12 | program.
| ||||||
13 | Section 30. Grant application and participation. The | ||||||
14 | Illinois Criminal Justice Information Authority shall | ||||||
15 | establish the objectives and provide direction for the | ||||||
16 | program's grant application process, by which qualified law | ||||||
17 | enforcement agencies can apply to receive funds for | ||||||
18 | microstamp-ready firearms or insertable microstamping | ||||||
19 | components or mechanisms, or both, for use by their officers. | ||||||
20 | Law enforcement agencies participating in the grant program | ||||||
21 | must have their officers using the microstamp-ready firearms | ||||||
22 | or insertable microstamping components or mechanisms, or both, | ||||||
23 | as soon as they are delivered. The Illinois Criminal Justice |

1 | Information Authority must establish the grant program and | ||||||
2 | post the Notice of Funding Opportunity no later than September | ||||||
3 | 1, 2022. | ||||||
4 | All grants under this program must be awarded by June 30, | ||||||
5 | 2023. | ||||||
6 | Law enforcement agencies that have been awarded funds must | ||||||
7 | use the funds within one year of receipt or the funds shall be | ||||||
8 | returned to the State treasury to be deposited into the | ||||||
9 | General Revenue Fund.
Funds are only to be used for the | ||||||
10 | purchase of microstamp-ready firearms or insertable | ||||||
11 | microstamping components or mechanisms to be installed in | ||||||
12 | firearms.

13 | Section 35. Data collection. The Illinois Criminal Justice | ||||||
14 | Information Authority shall collect data from each grant | ||||||
15 | recipient, including but not
limited to:
the number of | ||||||
16 | microstamp-ready firearms or insertable microstamping | ||||||
17 | components or mechanisms, or both, purchased,
manufacturer,
| ||||||
18 | number of officers using the microstamp-ready firearms, and
| ||||||
19 | the number of microstamp-ready firearms that are discharged in | ||||||
20 | the first year of use.
| ||||||
21 | Section 90. The Illinois Administrative Procedure Act is | ||||||
22 | amended by adding Section 5-45.21 as follows:

1 | Sec. 5-45.21. Emergency rulemaking; Illinois Criminal | ||||||
2 | Justice Information Authority. To provide for the expeditious | ||||||
3 | and timely implementation of the Microstamping Funding Program | ||||||
4 | Act, emergency rules implementing the Microstamping Funding | ||||||
5 | Program Act may be adopted in accordance with Section 5-45 by | ||||||
6 | the Illinois Criminal Justice Information Authority. The | ||||||
7 | adoption of emergency rules authorized by Section 5-45 and | ||||||
8 | this Section is deemed to be necessary for the public | ||||||
9 | interest, safety, and welfare. | ||||||
10 | This Section is repealed one year after the effective date | ||||||
11 | of this amendatory Act of the 102nd General Assembly.

12 | Section 95. The State Finance Act is amended by adding | ||||||
13 | Section 5.970 as follows:
