 Creates the Microstamping Funding Program Act. Creates in the State treasury the Microstamp-ready Firearms Fund to be administered by the Illinois Criminal Justice Information Authority for the purpose of issuing grants to law enforcement agencies to purchase or replenish microstamp-ready firearms or insertable microstamping components or mechanisms to be installed in firearms, or both, for their officers. Provides that subject to appropriation, the State Comptroller shall transfer from the General Revenue Fund to the Microstamp-ready Firearms Fund $500,000 to establish a grant program for microstamp-ready firearms in Illinois. Provides that the program shall award: (1) grants between $35,000 and $50,000, for the
replenishment of new microstamp-ready firearms or insertable microstamping components or mechanisms, or both, for their law enforcement officers. One of these grants shall be for
a State law enforcement agency, and the other 3 shall be for 3 municipal law
enforcement agencies of municipalities with a population between 50,000 and
200,000 that purchase firearms for their officers through a quartermaster
system, in which the quartermaster is responsible for the purchase, inventory,
and dissemination of uniforms and equipment to officers; and (2) grants between $5,000 to $20,000 to law enforcement
agencies of municipalities with a population between 30,000 and 200,000 to
assist with the purchase of firearms by new officers. Provides that the grant funds shall only be used for the purchase of microstamp-ready firearms or microstamping components or mechanisms, or both, to be installed in firearms by law enforcement agencies that are grant recipients. Provides that the Illinois Criminal Justice Information Authority must establish the grant program and post the Notice of Funding Opportunity no later than September 1, 2022. Provides for emergency rulemaking. Effective immediately.

1 AN ACT concerning firearms.


2 Be it enacted by the People of the State of Illinois,

3represented in the General Assembly:



4 Section 1. Short title. This Act may be cited as the 
5Microstamping Funding Program Act.

6 Section 5. Legislative findings. The General Assembly 
7finds that:
8 Law enforcement makes an arrest in only 35% of firearm 
9homicides and 21% of firearm
assaults when the victim was 
10Black or Hispanic.
Microstamping is a powerful crime-solving 
11tool that can help law enforcement quickly
solve gun crimes.

12Microstamping is a reliable ballistics identification tool, 
13and can greatly enhance
traditional ballistics analysis and 
14the current National Integrated Ballistics Information
Network 
15(NIBIN) system by providing a direct link between a spent 
16cartridge case and a
firearm.
17 The leads generated from fired cartridge cases, bearing 
18microstamps found at crime scenes, have the potential to help 
19law
enforcement solve gun-related crimes while limiting 
20negative interactions with law
enforcement, especially in 
21minority communities.
While this crime-solving technology 
22exists, firearm manufacturers have not yet produced

23microstamp-ready firearms.

1 It behooves the State to install a program in partnership 
2with law enforcement to bring
microstamp-ready firearms into 
3use in Illinois.

4 Section 10. Definitions. In this Act:
5 "CGIC" means the Crime Gun Intelligence Center.
6 "Microstamp-ready" means that the firearm is capable of 
7producing a unique
alphanumeric or geometric code on at least 
8one location on each expended cartridge
case that can be used 
9to identify the make, model, and serial number of the firearm.
10 "Microstamping component or mechanism" means a component 
11or mechanism of a firearm or an insertable component or 
12mechanism designed and intended
to produce a unique 
13alphanumeric or geometric code on an expended cartridge that

14identifies the make, model, and serial number of the firearm.
15 "NIBIN" means the National Integrated Ballistics 
16Information Network.

17 Section 15. Grants for microstamp-ready firearms or 
18insertable microstamping components or mechanisms, or both. 
19 (a) There is created in the State treasury the 
20Microstamp-ready Firearms Fund to be administered by the 
21Illinois Criminal Justice Information Authority for the 
22purpose of issuing grants to law enforcement agencies to 
23purchase or replenish microstamp-ready firearms or insertable 
24microstamping components or mechanisms to be installed in

1firearms, or both, for their officers. 
2 (b) Subject to appropriation, the State Comptroller shall 
3transfer from the General Revenue Fund to the Microstamp-ready 
4Firearms Fund $500,000 to establish a grant program for 
5microstamp-ready firearms in Illinois. The program shall 
6award:
7  (1) Replenishment grants: grants between $35,000 and 
8 $50,000, for the
replenishment of new microstamp-ready 
9 firearms or insertable microstamping components or 
10 mechanisms, or both, for their law enforcement officers. 
11 One of these grants shall be for
a State law enforcement 
12 agency, and the other 3 shall be for 3 municipal law

13 enforcement agencies of municipalities with a population 
14 between 50,000 and
200,000 that purchase firearms for 
15 their officers through a quartermaster
system, in which 
16 the quartermaster is responsible for the purchase, 
17 inventory,
and dissemination of uniforms and equipment to

19  (2) New officer grants: grants between $5,000 to 
20 $20,000 to law enforcement
agencies of municipalities with 
21 a population between 30,000 and 200,000 to
assist with the 
22 purchase of firearms by new officers.
23 (c) Nothing in this Act prohibits State or municipal law 
24enforcement agencies from purchasing or replenishing 
25microstamp-ready firearms or insertable microstamping 
26components or mechanisms, or both, for their law enforcement

1officers from funding sources independent of the provisions of 
2this Act.

3 Section 20. Administration and restrictions. The grant 
4program shall be administered by the Illinois Criminal Justice 
5Information Authority and the grant funds shall only be used 
6for the purchase of microstamp-ready firearms or microstamping 
7components or mechanisms, or both, to be installed in firearms 
8by law enforcement agencies that are grant recipients.

9 Section 25. Education and training. Education and training 
10associated with microstamp-ready firearms, and integration 
11with
the NIBIN and CGIC in Illinois shall be included in the 
12program.


13 Section 30. Grant application and participation. The 
14Illinois Criminal Justice Information Authority shall 
15establish the objectives and provide direction for the 
16program's grant application process, by which qualified law 
17enforcement agencies can apply to receive funds for 
18microstamp-ready firearms or insertable microstamping 
19components or mechanisms, or both, for use by their officers. 
20Law enforcement agencies participating in the grant program 
21must have their officers using the microstamp-ready firearms 
22or insertable microstamping components or mechanisms, or both, 
23as soon as they are delivered. The Illinois Criminal Justice

1Information Authority must establish the grant program and 
2post the Notice of Funding Opportunity no later than September 
31, 2022.
4 All grants under this program must be awarded by June 30, 
52023.
6 Law enforcement agencies that have been awarded funds must 
7use the funds within one year of receipt or the funds shall be 
8returned to the State treasury to be deposited into the 
9General Revenue Fund.
Funds are only to be used for the 
10purchase of microstamp-ready firearms or insertable 
11microstamping components or mechanisms to be installed in 
12firearms.

13 Section 35. Data collection. The Illinois Criminal Justice 
14Information Authority shall collect data from each grant 
15recipient, including but not
limited to:
the number of 
16microstamp-ready firearms or insertable microstamping 
17components or mechanisms, or both, purchased,
manufacturer,

18number of officers using the microstamp-ready firearms, and

19the number of microstamp-ready firearms that are discharged in 
20the first year of use.



21 Section 90. The Illinois Administrative Procedure Act is 
22amended by adding Section 5-45.21 as follows:

1 Sec. 5-45.21. Emergency rulemaking; Illinois Criminal 
2Justice Information Authority. To provide for the expeditious 
3and timely implementation of the Microstamping Funding Program 
4Act, emergency rules implementing the Microstamping Funding 
5Program Act may be adopted in accordance with Section 5-45 by 
6the Illinois Criminal Justice Information Authority. The 
7adoption of emergency rules authorized by Section 5-45 and 
8this Section is deemed to be necessary for the public 
9interest, safety, and welfare.
10 This Section is repealed one year after the effective date 
11of this amendatory Act of the 102nd General Assembly.

12 Section 95. The State Finance Act is amended by adding 
13Section 5.970 as follows:
