HOUSE BILL NO. 330
AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO FIREARMS.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 1445, Title 11 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
(4) The person sells, gives or otherwise transfers without compensation to a child person under 18 21 years of age a firearm or ammunition for a firearm, unless the person giving or otherwise transferring is that child's person’s parent or guardian, or unless the person giving or otherwise transferring first receives the permission of said the person’s parent or guardian; or
(5) The person sells or transfers for compensation to a person under 21 years of age a firearm or ammunition for a firearm, unless the person selling or transferring for compensation is that person’s parent or guardian; or
(5) (6) The person sells, gives or otherwise transfers a firearm to any person knowing that said person intends to commit any felony, class A misdemeanor or drug related criminal offense while in possession of said firearm.
Unlawfully dealing with a firearm or dangerous weapon is an unclassified misdemeanor, unless the person is convicted under paragraph s (4) or (5) of this section, in which case it is a class G felony, or unless the person is convicted under paragraph (5) (6) of this section, in which case it is a class E felony.
SYNOPSIS
This bill changes from 18 to 21 the age of a person to whom another person can sell, give, or transfer a firearm or ammunition for a firearm.
