AN ACT
amending title 13, chapter 31, Arizona Revised Statutes, by adding section 13‑3123; relating to firearms.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 13, chapter 31, Arizona Revised Statutes, is amended by adding section 13-3123, to read:
13-3123. Public accommodation building or structure; authorized possession of firearms; civil liability; definition
A. A person who is not prohibited from possessing a firearm pursuant to federal or state law may possess a firearm in any building or structure that is a public accommodation unless the owner or tenant or the agent of the owner or tenant specifically prohibits firearms in the building or structure or if firearms are prohibited pursuant to section 4‑229 or 13‑3102. Unless prohibited by law, The person may carry the firearm either concealed or in a visible manner.
B. A person is not subject to civil liability for engaging in conduct that is otherwise justified pursuant to chapter 4 of this title. The owner or tenant of a building or structure that is a public accommodation is not liable for the acts of a person who is otherwise justified in using deadly physical force pursuant to chapter 4 of this title.
C. The owner or tenant or the agent of the owner or tenant of a building or structure that is a public accommodation may adopt rules, guidelines, policies or regulations that apply to a person who possesses a firearm in the building or structure.
D. For the purposes of this section, "building or structure that is a public accommodation" includes a building or structure that is owned or operated by a religious organization, association or society, a nonprofit institution or organization that is operated, supervised or controlled by or in conjunction with a religious organization, association or society or a public or private hotel, restaurant, theater or museum.
